Registration of “illegal” foreigners as citizens of the Republic of Cyprus

According to the Civil Registry Law of 2002 (Law. 141 (I) / 2002) any adult person, having full mental capacity, may apply for registration as a citizen of the Republic of Cyprus (“Republic”), provided that the following conditions are met:

(a) is the spouse or widow(er) of a citizen of the Republic;

(b) resides with her husband / his wife in Cyprus for at least three years;

(c) is of good character;

(d) intends to continue to reside in the Republic or operate in the service of the Republic following his/her registration as a citizen of the Republic.

Until recently, a foreign national who illegally entered or resided in Cyprus was prevented from applying for registration as a citizen of the Republic. However, the situation has changed through the introduction of the Amending Law 44(I)/2015, published in the Official Gazette of the Republic of Cyprus on the 9th of April, 2015. In particular, the restriction may be waived in relation to “the alien spouse of a Cypriot citizen, who illegally resided within the areas controlled by the Republic of Cyprus”, at the Minister’s discretion.
